General
1. Welcome to the "Save a Child's Heart" website (the "Website"), operated by "Save a Child's Heart", A Registered Non-Profit Organization No. 580317493 or anyone acting on its behalf (the "Organization").
2. The Website includes, among other things, information about the Organization's activities to save the lives of children suffering from congenital heart defects in developing countries, through life-saving surgeries in Israel and the training of local doctors in their countries of origin. The Website presents stories of children in need of donations and allows for making donations, and for registering for volunteering and internship opportunities with the Organization.
3. By visiting, browsing, registering on the Website, using any of its services, including making a donation, or otherwise using the Website or the information contained therein (collectively, "Use"), the User confirms that they have read and agreed to these Terms and the Organization's Privacy Policy (as defined below), without any limitation or reservation. Such Use constitutes the User's consent to these Terms and a declaration that the User shall have no claim, demand, or lawsuit against the Organization, its officers, and anyone acting on its behalf.
4. The Organization protects the privacy of Website users in accordance with the Privacy Policy published on the Website (the "Privacy Policy"), as may be updated and amended from time to time. The Privacy Policy forms an integral part of the Terms, and the User's consent to the Terms constitutes their consent to the Privacy Policy.
5. The Organization reserves the right, at its sole discretion, to modify the provisions of the Terms from time to time or any other document that may replace it or be added to it to regulate the Terms. The User is requested to review this page periodically to read the updated Terms. Continued use of the Website after any such changes constitutes your acceptance of the new Terms.

Website Content and Services
1. The Website contains information, content and services, including the presentation of children's stories such as volunteer and internship projects of the Organization to which the User can apply to register.
2. The information appearing on the Website is offered to users "AS-IS". While we strive for accuracy, it is possible that the information is not complete or up-to-date, or that there are clerical or technical errors. The Organization is not responsible for inaccuracies, lack of updates, or errors and omissions in relation to the information, and the User shall have no claim in this regard.
3. The Website may include links to other websites or resources provided by third parties. These links are provided for your convenience only. The Organization has no control over the contents of those sites, does not endorse them, and accepts no responsibility for them or for any loss or damage that may arise from your use of them.
4. Upon registration for volunteering or an internship, or when making a donation, the User may be asked to provide certain personal details, which may include, for example, full name, email address, phone number, ID number, and credit card details, as applicable. The User is not obligated to provide these details, but failure to do so may limit the User from performing the desired action on the Website. By entering any details, the User declares that these are their details and that they are correct, complete, and accurate.
Making Donations
1. The Organization allows for monetary donations for the Organization's activities through the Website (the “Donations”). Only individuals aged 18 and over, who hold a valid payment method, are permitted to donate.
2. Donations are processed through third-party payment services providers (the "Payment Company"). The processing of Donations is subject to the terms and conditions and privacy policies of the relevant Payment Company, and the Organization is not responsible for any act or omission of the Payment Company. The Organization does not collect or store full credit card data or other sensitive payment information.
3. After the donation is approved, the Organization will issue a donation confirmation to the donor in accordance with the provisions of the law.
4. For the avoidance of doubt, all donations are voluntary and, except as required by law or in cases of proven technical error, are final and non-refundable. The Organization shall use the donated funds solely for its stated objectives.
Intellectual Property
1. The Website and all its components, including text, software, images, video, graphics, sounds, and other material (the "content"), are the exclusive property of the Organization or are used under explicit authorization from the relevant rights holder.
2. Use of the Website and its Content does not grant the User any rights in said intellectual property, other than the limited right to use the Website in accordance with these Terms.
3. Any copying, distribution, transmission, publication, creation of a link, modification, or commercial exploitation of the Website or its content, in whole or in part, without the Organization's prior express written consent, is strictly prohibited.
4. All trademarks of the Organization appearing on the Website are the sole and exclusive property of the Organization.
User Obligations
1. The User undertakes to use the Website and its services only for lawful purposes and in accordance with these Terms. The User agrees not to link to, upload, distribute, or publish any material that: (a) Violates any rights, including intellectual property rights, privacy rights, or any other proprietary right; (b) Is illegal, threatening, abusive, defamatory, racist, offensive, or pornographic in nature; (c) Includes any virus, malware, Trojan horse, or other software that may damage or interfere with the computer systems of the Organization or any third party; (d) Constitutes any form of advertising or commercial solicitation without the prior written consent of the Organization.
2. The User agrees not to make changes or interfere in any way with the source code of the Website and not to upload any software or application that could harm or cause damage to the Organization, the Website, or any third parties.
3. The User agrees not to link to the Website from any site containing illegal, offensive, or defamatory content, nor in a manner that falsely states or implies that the Organization endorses the User's website, products, or services.
4. The User agrees that, without prejudice to any other right of the Organization, in cases where the Organization has a concern that the User's use of the Website does not comply with the provisions of these Terms or any applicable law, the Organization shall be entitled to track the User's use, prevent the User's access to the Website, block the User, and take any other action it deems appropriate to protect its property and rights.
Limitation of Liability
1. The use of the Website and its content is at the User's sole risk. The Organization bears no responsibility whatsoever for the content of the Website and is not responsible for the correctness or accuracy of any information contained therein. The information is offered "AS-IS", and the User shall have no claim in this regard.
2. The Organization is not responsible for damages caused to users or third parties as a result of using the Website or the inability to use it, including due to software (such as viruses) or malfunctions. The User is solely responsible for any interaction with other users on the Website.
3. The User acknowledges that the use of the Internet may involve disruptions that are beyond the Organization's control and that the Website may be unavailable from time to time for various reasons. The User releases the Organization from any damage or loss that may be caused due to the above.
4. The User undertakes to indemnify and compensate the Organization or anyone acting on its behalf for any damage, liability, costs, or expenses (including legal expenses) that may be caused to the Organization in connection with any act or omission of the User in breach of these Terms, the Privacy Policy or any applicable law.
5. The Organization shall not be liable for any act or omission originating from force majeure, including, but not limited to, security events, health emergencies, pandemics, strikes, or major infrastructure failures (including the Internet network or electricity).
6. As stated above, the Organization is not responsible for any acts or omissions of third parties, including Payment Companies or external websites, and shall not be liable for any damage or loss caused as a result of using such third-party services or content.
Governing Law and Jurisdiction
1. The law applicable to all matters related to this Website and its interpretation shall be the Israeli law only, and the exclusive jurisdiction in connection with the Terms of the Website is granted to the competent court in Tel Aviv only.
2. It is clarified that the provisions of this section also apply to a User who is not a resident or citizen of Israel, and in no case shall a claim be heard that Israel is not a convenient forum or that foreign law should apply to any engagement related to this Website.
Miscellaneous
1. The User agrees that the use of the Website in any way does not create any connection or relationship between the Organization and the User that extends beyond those specified in the Terms.
2. Should any clause in the Terms be found invalid, unenforceable, or illegal for any reason by a competent court, the validity or enforceability of the remaining Terms shall not be affected; without derogating from the above, the clause found invalid, unenforceable, or illegal shall be interpreted in a manner closest to its wording and purpose, so that following such interpretation it shall not be found invalid, unenforceable, or illegal.
3. No conduct, waiver, omission, delay, or postponement on the part of the Organization in exercising any of its rights under the Terms or the law, in a specific case or a series of cases, shall be deemed a waiver of any of its rights or as consent to any breach or non-fulfillment of the Terms or as granting a delay or extension or as a change, cancellation or addition of any condition, unless made in writing and explicitly. Deviation from the Terms by the Organization in a specific case or a series of cases shall not constitute a precedent and shall not be inferred as a general rule for any other future case.
4. The Organization may assign its rights on the Website and under the Terms, in whole or in part, to a third party without the need for the User's consent.
5. The Organization reserves the right, at its sole discretion, at any time and without prior notice, to modify, suspend, or cease operating the Website or any part thereof. This includes the right to remove or add services, or make changes to the Website's content or design. The User shall have no claim or demand against the Organization due to the execution of such changes or any malfunctions that occur.
